Man left bleeding after full can of Coke thrown at him in Magherafelt

A Ballyronan man who threw a full can of coke at an 'innocent individual' was given a two-month jail sentence suspended for two years at Magherafelt Magistrates Court.

James Patrick Maguire, 25, of Cove Close in the village, admitted assaulting Mark McKee in Magherafelt town centre in the early hours of October 31 last year.

The court heard at 1.10am police attended an incident at Queen Street involving five males.

A prosecuting lawyer said police saw one man bleeding from a mouth injury and observed the defendant walking off in the direction of the Diamond area, where he was apprehended by the police.

She said Maguire was identified by the injured party and was taken to Dungannon police station for interview.

The barrister said defendant stated that he could not remember what happened due to the amount of alcohol he had consumed on the night.

However, in a subsequent interview with police, Maguire admitted he had thrown a tin of coke at the injured party.

Defence barrister Liam McStay explained that the defendant had been in licensed premises and later a chip shop where there was some disturbance.

Mr McStay said the defendant threw a can of coke which unintentionally struck an innocent individual.

District Judge Alan White ordered Maguire to pay the injured part £250 compensation.
